It is the desire of our entire team here at Happy Valley Event & Party to ensure that every customer feels well taken care of through top notch, timely, customer service, and experiences a smooth ordering and fulfillment process. Through a shared understanding, we can experience success together between our team and you, our valued customers.

The Terms and Conditions below are meant to outline expectations on the part of the rental company, Happy Valley Event & Party (known below as HV!) and the rental customer (known below as Customer).

We ask that you read this document carefully and invite you to reach out with questions or clarifications as needed or desired prior to acknowledging and signing the Terms and Conditions agreement. It is important to Happy Valley Event & Party that you, our valued customer, understand the Terms and Conditions outlined below.

Customers of Happy Valley Event & Party are required to accept all Terms and Conditions outlined below by acknowledging via signature and date prior to final rental delivery.

 

Delivery of Rental Items

1. Customer Event Date(s):

  1. Scheduled at time of original order, the event date must be confirmed 14+ days prior to the scheduled event date. The event date is for a single-day rental only.

  2. Extended event date requests require a minimum 5 business day advance notice and additional rental fees will apply. Extended event date requests will be considered and granted based on availability.

2. Delivery Options

  1. Return/Pick Up Date- Within 24-48 hours after event date unless otherwise agreed upon.

  2. Customer Pick Up/Return Date- Customer may opt to self-pick up, deliver, and return rental items. Please discuss limitations, restrictions, and scheduling options with our team. Return Date must be within 48 hours of Event Date.

  3. Standard Delivery- Includes delivery up to 24 hours before event date and pick-up 24-48 hours after event date. Final scheduling will apply. HV! delivery team will drop off at the garage, front door, or any ground-level sidewalk/hard, even surface (no rock or dirt) location where our truck can safely back up. HV! does not carry items upstairs, into backyards, interior private/ public, commercial homes or venues or long distance’s locations and requests of these and similar conditions qualify under Special Delivery, outlined below.

  4. Special Delivery- Requests may be discussed and included for any rental. Additional labor charges may apply which must be reviewed, approved, and paid for, a minimum of, 5 days prior to Event Date. Including but not limited to, backyard delivery/pick up, staging, set up, take down, in-home, venue delivery, and more. HV! offers an array of labor services. On-site courtesy inspections are available. Customer must request in advance and pay for at time of booking. Up to 5 business days’ notice.

  5. Delivery Date Up to 24 hours prior to Event Date.

Rental Inspections, Damage and Loss

HV! Strives for high quality and clean rental items. Nicks, bumps and normal, rental-use wear and tear are common and to be expected.

  1. Inspection- Customer and/or Customer Representative (18 years or older) is required to inspect all delivered or Customer pick-up rental items upon receipt. It is the responsibility of the Customer or Customer Representative to inspect the rental items and notify HV! of any defects or damage. HV! offers an inspection window of up to 2 hours from receipt. Photo(s) by email or text are required. After this time, all items are considered delivered in good condition. After inspection, Customer is responsible for all HV! rental items in possession.

  2. Defective Items- Defective or damaged rentals which have been reported within delivery inspection period may, and at the discretion of HV!, be repaired, replaced, or discounted. Only HV! will determine if item(s) qualify for these options.

  3. Lost/Damaged Items- Lost, damaged, or destroyed items will be charged to Customer for repair or replacement cost, as applicable. This includes, but is not limited to, rental items which are stained, broken, chipped, loose, weather stained or damaged. HV! Rental Insurance is available. Ask for details.

  4. HV! Set Up/Take Down Team is available as an additional service and will be responsible for rental items set up and/or take down and cleaning of items.

Cleaning and Returning Rental Items

  1. Customer is responsible for removal of all food, debris and miscellaneous from the surface of rental items.

  2. Customer is responsible for wipe-down and cleaning of all tables, chairs, and surfaces. Linen is to be free of all food, liquid, flatware, beverageware and miscellaneous.

  3. Linen is to be placed in an HV! provided linen bag for rental return.

  4. All items must be returned in original or equivalent containers, which may include bins, racks, crates, or dollies.

  5. All rental items are to be returned to and staged at drop off delivery location for HV! Return Team pick up

  6. Items not thoroughly cleaned or repackaged may incur additional cleaning and handling fees.

  7. Customer caused time delays and/or unscheduled assistance required may incur additional fees that will be charged to Customer credit card on file.

HV! Set Up/Take Down Team

  1. HV! shall provide a team to perform the set up and take-down of all rented items as specified in the rental agreement. Set up will be completed prior to the start time and take down will occur promptly following the conclusion of the event. The Customer shall ensure that the venue is accessible and ready for set up at the agreed-upon time.

  2. HV! shall not be responsible for delays caused by the venue inaccessibility, third-party interference, or unsafe conditions. Any additional labor or time required due to such may result in additional charges. The Customer agrees to hold the company harmless for any damage or loss resulting from improper venue conditions or interference by non-company personnel during set up or take down.

Rental Storage and Optional Equipment Protection Plan (EPP)

  1. The Customer is responsible for the care and safekeeping of all rented items from the time of delivery and inspection, through the pickup and confirmation of the items return condition.

  2. HV! offers an optional ‘Equipment Protection Plan (EPP)’ for an additional fee of 10% of your entire order (less tax), which covers accidental damage by the Customer or its guests, due to normal use. The EPP does not cover loss, theft, vandalism, gross negligence, or damage caused by misuse, unauthorized modifications, or exposure to extreme conditions such as but not limited to fire, flood, water exposure, or unrealistic weight limitations.

  3. If the Customer declines the optional purchase of the Equipment Protection Plan, the Customer assumes full fiscal responsibility and financial recovery to HV! in the amount of the current retail value of each impacted item. A recover quote will be delivered to the Customer within 72 hours, and the Customer is responsible for payment of such items within 7 days from receipt of replacement value statement.

Deposit, Cancelation and Refund Policies

  1. Rental Confirmation and Payment- A 50% deposit in the amount of the Customers’ total contracted order is due 14 days out from contracted delivery date to secure rental items, hold them out of inventory, and for the scheduling of and staff and services needed. The rental and service agreement will only be considered confirmed upon receipt of the Customer deposit and the signed agreement. Final payment of the contracted rental and service items is due three days prior to delivery of rental items.

  2. Cancelation Fee and Recovery- For extenuating circumstances, as determined and approved by HV!, a refund will be considered if cancelation fee will be charged to the Customer if the cancelation is necessary within 10-14 days of the delivery date. Should cancelation occur between 1 and 9 days ahead of the Customers’ delivery date, we are happy to collaborate with the Customer in consideration of a credit toward future rentals. Such credit, if provided, will be valid for up to one year from initial delivery date. HV! is unable to provide any refunds of deposited funds if the Customer cancels between 10-14 days before the delivery date, accept in the case of force majeure.

Cancellation of Rental Items and Services

All cancelations must be submitted in writing and sent to HV! email to support@hveventparty.com.

Disclaimer and Hold Harmless

The Customer acknowledges that HV! is not the manufacturer of the rental products being offered and provided in the sales agreement. HV! makes no representations or warranties, expressed or implied. The Customer agrees to hold HV! harmless from all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or related to the use, performance, or failure of the rented products.

Permits and Licenses

  1. The Customer is solely responsible for obtaining all permits, licenses, permissions, or approvals required by local, state, or federal authorities for the use of the rented items and services at the event location. This includes, but is not limited to, permits for public gatherings, park or venue use, fire department approvals, noise ordinances, and electrical access.

  2. The Company shall not be held liable for any fines, penalties, delays, or cancelations resulting from the Customers’ failure to secure the necessary permits and licenses. If the event is delayed or canceled due to lack of proper authorization, the Customer remains responsible for all rental fees and associated costs as outlined in this agreement.

Force Majeure

  1. HV! shall not be held liable for any failure or delay in the performance of its obligations under this agreement if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God.

  2. Upon the occurrence of a force majeure event, the HV! shall promptly notify the Customer in writing, describing the nature of the event and its expanded duration. The Customer shall use commercially reasonable efforts to mitigate the impact and resume performance as soon as practicable.

Photography and Video Engagement

  1. HV! may photograph and/or capture video of your event setup to showcase our work for promotional use, including social media, our website, and digital/print materials. This may include sharing photos provided by the Customer to be included in a community shared space on our website called ‘Ideas and Inspiration,’ an ever-evolving space to share event decor and design inspiration among current and prospective Customer.

  2. If you prefer not to have your event featured, simply let us know in writing before your event, and we will fully respect your request.

Best Efforts

Each party agrees to use its ‘best efforts,’ in good faith, and with due diligence, to fulfill its obligations under this agreement. Engaging in ‘best effort’ means taking all reasonable steps that a prudent and competent party would take under similar circumstances to achieve the intended outcome for all concerned, including but not limited to allocating sufficient resources, personnel, and time. However, this clause does not require a party to take actions that would result in unreasonable expense, risk, or disruption to its business operations.
